New forms and rules are being introduced to streamline the probate application process.
From 1 June 2009, persons wishing apply for a grant of probate, letters of administration or a reseal will need to prepare UCPR Form 111 . This form will replace SCR Form 90.
Applicants will need to lodge:
- two copies of UCPR Form 112 (if you are applying for a grant or letters of administration), or UCPR Form 113 (for reseal applications only),
- if relevant, the original will and codicil/s
- if relevant, the original grant to be resealed and a copy of that grant
- the affidavit/s required under SCR Part 78
- two copies of any supporting documentation required under the revised SCR Part 78, rule 8. These two sets of documents must be stapled together on the left hand side of the page, and accompanied by a stamped, self-addressed A4 envelope. As one of these copies will become the probate grant document the registry does accept this document being provided on heavy grade paper and/or with a cardboard backing sheet.

If the application is in order and a grant can be made, the Court will post the sealed grant/letters of administration/reseal to the applicant in the stamped self-addressed A4 envelope provided within a reasonable period, but usually within 5 clear working days of receipt.
If the form of grant requires changes, the Court will return it to the applicant with a probate requisition sheet that sets out the grant's deficiencies. When the applicant answers the requisition, he or she must also send a copy of the requisition and a stamped self-addressed A4 envelope.

- Form 113 - reseal of probate granted in another jurisdiction (see information sheet for further guidance about how to complete this Form).
