Telephone Directions Hearing

Practice & Procedure

Introduction
The Land and Environment Court has a dedicated telephone conference call facility in Court 3B, Level 3, 225 Macquarie Street Sydney, that allows a directions hearing to be conducted with parties appearing either in person or over the telephone. This facility is used principally for directions hearings before the Registrar where the parties or their representatives are from outside of the Sydney area.

In addition to the telephone directions hearing process, the facility has also been used by judges and commissioners of the Court to:
  • deal with urgent interlocutory applications;
  • to deal with consent orders where the parties and practitioners are in rural NSW;
  • to conduct case management conferences, mentions and directions hearings.

The telephone directions hearing list
All matters in Classes 1, 2 and 8 outside the Sydney region are placed in the telephone directions hearing list. Matters in Classes 3, 4, 6 and 7 which are outside the Sydney metropolitan region may also be placed in the telephone directions hearing list by the request of the applicant at the time of commencement of the proceedings, or by request of the parties or direction of the Court.

Telephone directions hearings take place every Monday, and at other times by special arrangement. Matters in the telephone directions hearing list may move to the Sydney directions hearing list by consent, or at the direction of the Registrar.

At the appointed time on the date of the directions hearing, parties or their representatives can have the matter dealt with either by telephone through the telephone conference facilities, or by appearing in court in person.

Directions and orders which may be obtained by telephone:
  • adjournments and directions
  • dates for hearing, conciliation conferences, mediation or case management conferences.

How does a telephone directions hearing work?
  1. When an application is filed with the Court, a date and time for the directions hearing will be noted on the documents to be served;
  2. Just prior to the appointed time the parties should dial into the telephone conference facilities for the directions hearing. The dial in number for all parties is 02 8251 8146.
  3. The operator will welcome the parties and request their names, telephone numbers and the conference Registrar’s name. The parties will be placed on hold with music playing until connected;
  4. Once connected, the presiding Registrar will deal with the matter in a three-way conference call and make directions/ orders. On each occasion, before speaking, parties are to identify themselves;
  5. At the end of the directions hearing, the parties will hang up.
Telephone conference facilities can still be used where one party appears in court.

Can I get a transcript of the telephone directions hearing?
The directions hearing will be taped and a copy of the tape sent to the Court by conference call provider. Copies of the tape may be purchased from the Court.

How much does it cost to participate in a telephone directions hearing?
The cost to parties participating in a telephone directions hearing is:
  • Total Price $0.44 per minute / per link ($0.40 + $0.04 GST) for the duration of the conference;
  • Plus the cost of the call to the ‘02’ number. This could involve local, SDT or IDD call charges depending on the location of the party dialling in.

These charges will be billed to parties’ nominated Australian fixed telephone number.
